Preterea, resigno, concedo, et hoc scripto meo omnino quietumclamo, pro me et heredibus meis, Herberto de Mackeswelle et heredibus suis vel suis assignatis, et heredibus eorum, quicquid iuris habui vel habere potui in aduocatione ecclesie de Pencatelande cum suis pertinenciis ; ita uero quod nec ego nec heredes mei seu aliqui nomine meo vel ex parte mea vel heredum meorum contra aliquem a dicto Herberto et heredibus suis vel suis assignatis et eorum heredibus ad predictam ecclesiam aliquo tempore presentatum vel presentandum obicere valeamus, quod dicta ecclesia in fundo meo sita sit : Volo eciam et concedo quod nec ista excepcio nec aliqua alia excepcio siue racio vel eciam aliqua impetracio a curia Romana vel ab aliqua alia curia michi vel heredibus meis aliquo tempore vel aliquo modo valeat vel valere posit contra dictum Herbertum

John of Pencaitland to all those reading or hearing this writing, eternal greetings in the Lord. Let it be known to all of you that I have resigned, granted, and by this my writing quitclaimed in all things to Herbert of Maxwell and to his heirs or to his assignees and to their heirs forever, on the first Monday after the Ascension of the Lord in the year of grace 1276, in the presence of Lord Hugh of Berkeley, at that time justiciar of Lothian, in full court at the Castle of the Maidens, in the presence of many responsible men, whatever right I had or I might have had in the land of Pencaitland (East Lothian) from the western side of the water of Tyne, without any reservation; indeed the land of which William of Douglas, John of Lamberton [and] Richard of Bickerton, knights, sent by the Lord King to make an extent of the said land, made a survey by faithful [men] of the country, together with the lady’s old garden, and ‘le Gollikroc’, and ‘le Horseparrokys’, and ‘le Fuylstrother’, and ‘le Coteyarde’, and ‘le Vyuere’, and with all the other things the right to which I sought or ought to have sought out beyond the extent made in the said land, except the wood of the south side and the wood which Lord Alan of Ormiston holds of me in his lifetime, which will revert to me and my heirs after his death, except also ‘le Ruthirkroc’ for which I and my heirs will pay one pound of cumin annually in the name of rent to the said Herbert of Maxwell and his heirs or his assignees, and their heirs, and except eight shillings of castleward rendered annually to me and my heirs. Moreover, I resign, grant, and by this my writing quitclaim in all things for me and my heirs, to Herbert of Maxwell and his heirs or his assignees and their heirs, whatever right which I had or which I might have had in the advowson of the church of Pencaitland with its pertinents, so that truly neither I nor my heirs nor anyone nominated by me or on behalf of me or of my heirs may be able to object to anyone presented by the said Herbert and his heirs or his assignees and their heirs to the said church at any time, which said church is situated in my foundation. I also will and grant that neither this exception nor any other exception or reason or any suit from the Roman court or from any other court as well to me or to my heirs at any time or in any manner be valid or may be valid against the said Herbert and his heirs or his assignees and their heirs, or against anyone as well presented to the said church by them at any time; indeed, each and every thing that is said above, I will, grant and quitclaim in all things, and by this my writing confirm, for me and my heirs, to the said Herbert and his heirs or his assignees and their heirs, no opposing proposition. In testimony of these things and in perpetual strength, I have attached my seal to this writing. By these witnesses: John Comyn the son, John of Lindsey, Richard Fraser, John of Lamberton, Walter of Lindsey, lord of Thurston, knights, William of Lindsey, Ralph of Echline, and others. Truly, because my seal is not very old nor is it known, Lord Hugh of Berkeley, at that time justiciar of Lothian, and Lord Simon Fraser have borne witness to my seal, by my request, they have caused their seals to be attached to this present writing.
